In a groundbreaking judgment involving a spousal immigration case, Canada’s Federal Court has entered uncharted territory by broadening the definition of conjugal relationship to include mixed-orientation couples who are otherwise committed and dependent on each other. In granting an appeal by the gay man and his heterosexual partner, referred to in court as AP and AM, Justice Janet M. Fuhrer said the Immigration Appeal Division was wrong and unreasonable in rejecting their spousal sponsorship application.

A Canadian woman who is entering the last month of her pregnancy was finally able to return home to Canada, after the federal government granted last-minute temporary resident visas to her soon-to-be adopted Haitian children. Sarah Wallace, her husband, Jean-Pierre Valteau, and their three children — Jean-Jacques Valteau, Jean-Moise Kessa, and Eva-Maria Doris — flew in to Vancouver Saturday afternoon. Immigration Canada issued the visas late Friday night as the family was en route to Seattle.

Mariam Galstyan arrived in Canada from Russia 10 months ago to be with her husband. “We were planning to stay in Canada, which is why we applied for a work permit and residence permit,” explained Galstyan. They were told by the federal government her immigration application would take up to one year. In March, the application was sent to Quebec for the Quebec Selection Certificate, but the system had shut down due to COVID-19. It now has a large backlog.

Global News – Coronavirus: Ottawa to Ease Border Restrictions for Compassionate Visits by Foreign Nationals

The federal government is expected to announce next week that it will ease border restrictions that were preventing Canadians from seeing family members and loved ones that are foreign nationals living in another country. The federal government’s definition of “immediate family” is too restrictive, says a group called Faces of Advocacy, which held a virtual rally Saturday where MPs from all parties, including from the governing Liberals, spoke in favour of broadening that definition to allow more Canadians to unite with families and loved ones.
