Ottawa Citizen – Immigration Board Rebuked By Court

The Federal Court has once again rebuked the Immigration and Refugee Board for the way it probed the genuineness of a refugee claimant’s spiritual beliefs and practices. “The Board is tasked with assessing the applicant’s credibility and not the soundness of his theology,” Justice Donald J. Rennie wrote in a decision. […] The judge’s remarks stem from a decision last year by an IRB adjudicator to deny the refugee claim of Zhang Sheng Wang, who said he feared persecution in his native China because of his practice of Falun Gong.

Canada.com – Migrants Who Survived Yacht Accidents Still Detained

Migrants saved from a sinking 11-metre vessel in the treacherous North Atlantic could be detained for another month, according to the Immigration and Refugee Board. The sailors had detention hearings Thursday, and spokesman Robert Gervais said they will remain in detention, with another hearing scheduled for May 4, if necessary. The hearing was not public and Gervais would not say why the migrants’ detention has been extended. Sharry Aiken, a law professor at Queen’s University, said the migrants — three of nine who were aboard the S/V Tabasco II before it capsized last week — should have had the chance to seek legal representation.
