In a precedent-setting decision, the Human Rights Tribunal of Ontario has ruled that an employer cannot discriminate against job candidates who do not have Canadian permanent residence status or citizenship but are legally able to work here. The decision follows a complaint from Muhammad Taimoor Haseeb, a former international student who was offered a position as an engineer in Sarnia by Imperial Oil in 2014. The offer was later rescinded after the company learned Haseeb did not have permanent status in Canada — though he was eligible for a three-year postgraduate work permit.
Depending on who you ask, using the word “illegal” to describe border crossers is either a matter of “semantics” or a dangerous use of language, the result of which is to dehumanize and falsely criminalize anyone seeking asylum in Canada who doesn’t cross the border normally. Legal experts and human rights advocates — including representatives from the United Nations and Amnesty International — have urged Canadian politicians and journalists to think carefully before they speak and to consider the effects language might have, both on asylum-seekers and the Canadian population as a whole.

In a letter released on Thursday, Ontario Community and Social Services Minister Lisa MacLeod said the federal government owes the province $200-million for the costs of resettling thousands of asylum seekers who have crossed the Canada-U.S. border. A senior federal immigration official, who spoke to reporters on condition of anonymity on Thursday, said Ontario will have to talk to Ottawa if it wants to seek reimbursement for any costs associated with asylum seekers, as other provinces and municipalities have.
